Ownership of the Site; Agreement to Terms of Use

The following Terms of Use (the “Terms”) apply to your access to and use of the Refundo website, located at www.Refundo.com, and all associated sites linked to www.Refundo.com by Refundo, its subsidiaries, and affiliates globally (collectively referred to as the “Site”). The Site is owned by Refundo Inc. (“Refundo”) and its licensors. BY ACCESSING OR USING THIS SITE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU MUST CEASE USING THE SITE. You must be at least 18 years old to use this Site. By using the Site, you represent and warrant that you are at least 18 years of age.

Refundo reserves the right to amend, modify, or remove portions of these Terms at its discretion. It is your responsibility to review these Terms periodically. Continued use of the Site after such changes constitutes your acceptance of the new terms. Provided you comply with these Terms, Refundo grants you a personal, non-transferable, limited license to access and use the Site.

Site Content

The content on the Site, including but not limited to text, graphics, logos, designs, images, software, music, and other materials (collectively, “Content”), is owned or licensed by Refundo and is protected by applicable intellectual property laws, including copyright, trademark, and patent rights.

Unless explicitly allowed in these Terms, you are not authorized to copy, reproduce, distribute, modify, or create derivative works based on any part of the Site or its Content, including but not limited to its structure, design, and functionality. You may access and download content that Refundo has made available for such use, provided you comply with all terms related to those materials.

Refundo is not responsible for any third-party acts or omissions or for any viruses or other harmful components that may affect your system when using the Site.

Limitation of Liability

To the fullest extent allowed by law, Refundo will not be liable to you for any indirect, incidental, special, or consequential damages, including loss of profits, arising out of or in connection with your use of the Site or these Terms.

In the event of liability, Refundo’s total liability to you will not exceed the greater of the total fees you have paid to Refundo for any service or feature within the past six months, or$100 USD.

Indemnification

You agree to indemnify and hold harmless Refundo and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, or expenses (including legal fees) arising out of your use of the Site or your violation of these Terms.

Refundo reserves the right to suspend or terminate your access to the Site if you violate these Terms, engage in prohibited activities, or for any other reason at its discretion.

Consequences for engaging in prohibited activities may include, but are not limited to, immediate termination of your account, legal action, and reporting to appropriate authorities. You agree that Refundo will not be liable to you or any third party for such suspension or termination.

Governing Law; Dispute Resolution

These Terms will be governed by the laws of the United States and the State of New Jersey. Any disputes relating to these Terms or your use of the Site will be resolved in the courts located in Essex County, New Jersey.

In the event of a dispute between users, we encourage you to first attempt to resolve the issue directly with the other party. If that is unsuccessful, you may contact Refundo's customer support for mediation. We reserve the right to suspend or terminate accounts of users who repeatedly engage in disputes or violate our terms. For any legal disputes that cannot be resolved through these means, you agree to resolve them through binding arbitration in accordance with the American Arbitration Association's rules.

Miscellaneous

These Terms of Use constitute the entire agreement between you and Refundo regarding your use of the Site. If any part of these Terms is held to be invalid or unenforceable, the rest will remain in effect. Refundo’s failure to enforce any provision of these Terms does not waive its right to do so in the future.

By using the Site, you agree to comply with all applicable laws.

Any feedback you provide to Refundo through the Site is considered non-confidential. Refundo may use your feedback for any purpose without compensation to you.
